Terms of Service

Last updated: October 10, 2026

1. Acceptance of Terms

By accessing or using Tovan ("the Service"), operated at tovan.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users.

2. Description of Service

Tovan is an AI-powered hardware design platform that allows users to design electronic circuits and matching enclosures through a conversational chat interface. The Service generates schematics, PCB layouts, enclosure 3D models, and related design files using artificial intelligence. Users can view, edit, and export their designs as Gerber files for PCB manufacturing and as STL files for 3D-printing their enclosure.

3. Accounts

Using Tovan requires an account, created with email, GitHub, or Google authentication. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account.

  • You must be at least 13 years of age to use the Service.
  • You may not share your account with others or create multiple accounts to circumvent usage limits.
  • You must provide accurate information when creating an account.
  • You are responsible for notifying us promptly if you suspect unauthorized access to your account.

4. Subscriptions & Billing

Tovan offers a free tier with usage limits and Pro and Power subscription plans. Paid plans are billed monthly via Stripe at the prices displayed on our pricing page.

  • Subscriptions renew automatically each billing cycle unless cancelled.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will retain access to paid features until then.
  • No partial refunds are provided for the current billing period upon cancellation.
  • We reserve the right to change subscription pricing with at least 30 days notice. Price changes will take effect at the start of your next billing cycle after the notice period.
  • The free tier includes a usage allowance that refills every 7 days, counted from when you created your account. When it runs out, AI features pause until it refills or you subscribe to a paid plan. Adding one-time usage is available on paid plans.

5. AI-Generated Content

This is an important section. Please read it carefully.

Tovan uses artificial intelligence to generate circuit designs, schematics, PCB layouts, component selections, enclosure 3D models, and related technical content. While we strive for accuracy, AI-generated output is provided on an "as-is" basis and is intended as a starting point for your designs, not as a finished product ready for production.

You acknowledge and agree that:

  • AI-generated designs may contain errors, including incorrect component values, wrong pin assignments, invalid footprints, faulty circuit topologies, incorrect enclosure dimensions, mechanical interference between board and enclosure, insufficient wall thickness, or other inaccuracies.
  • You are solely responsible for reviewing, verifying, and validating all AI-generated designs before manufacturing, 3D printing, deployment, or any other use.
  • Designs should be reviewed by a qualified engineer before being sent to production, especially for safety-critical or high-reliability applications.
  • Tovan is not liable for any damages, losses, or costs arising from errors in AI-generated content, including but not limited to defective manufactured boards, failed prints, ill-fitting enclosures, component failures, or safety incidents.
  • AI-generated designs do not constitute professional engineering advice.

6. Third-Party Component Data

The Service sources electronic component data, footprints, symbols, and specifications from external component databases and library providers. This data is provided for convenience and reference.

  • Tovan does not represent that this third-party data is accurate, complete, or up-to-date.
  • Component footprints, pinouts, specifications, and stock availability may be inaccurate or outdated.
  • You should always verify component data against the manufacturer's official datasheet before finalizing a design for production.
  • Tovan is not responsible for errors originating from third-party data sources.

7. Intellectual Property

Your Content

You retain ownership of the circuit designs, project files, and other content you create using Tovan. By using the Service, you grant Tovan a limited, non-exclusive license to store, process, display, and back up your content for the purpose of providing, developing and improving the Service, including training machine learning models on board designs, within the limits described in our Privacy Policy. You can turn off the use of your boards for training at any time in your account menu.

Our Property

Tovan, its branding, the platform software, user interface, AI integrations, and all related technology are the property of Tovan. You may not copy, modify, distribute, or create derivative works of the Service itself.

8. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated tools, bots, or scripts to scrape content or interact with the Service beyond normal use.
  • Attempt to circumvent usage limits, authentication, or security measures.
  • Share your account credentials with others or allow multiple people to use a single account.
  • Use the Service for any illegal purpose or in violation of any applicable laws.
  • Interfere with or disrupt the Service or servers connected to the Service.

9. Export & Manufacturing

Tovan allows you to export your designs as Gerber files, Bill of Materials (BOM) files, and Pick-and-Place (CPL) files for PCB manufacturing, and as STL files for 3D-printing your enclosure. These exports are intended to facilitate the manufacturing process.

  • Exported files are provided "as-is" without warranty of fitness for manufacturing.
  • You are solely responsible for verifying that exported files meet the requirements of your chosen manufacturer or 3D-printing service.
  • Tovan is not responsible for the outcome of any manufacturing process, including defective boards, failed prints, wasted materials, or production delays caused by design file errors.
  • You assume all risk associated with sending designs to fabrication, assembly, or 3D-printing services.

10. Ordering (Boards & Enclosures)

When you submit a quote request through Tovan, we arrange production of the physical board and, if requested, the matching 3D-printed enclosure on your behalf using third-party fabrication, assembly, and 3D-printing partners.

Boards and enclosures ordered through Tovan are custom goods produced to the design files you approve at the time of payment. They are non-refundable and non-returnable except as expressly described in this Section.

Quote and Order Process

  • Submitting a quote request does not place an order or charge your payment method. We email you a quote with line items and a payment link; the order is placed only when you complete payment through that link.
  • Quoted prices are valid for the period stated in the quote. Prices may change after that period due to component cost or supplier availability.
  • Tovan does not guarantee a production or delivery timeline for any order. Tovan is not liable for delays caused by fabrication, assembly, or 3D-printing partners, component sourcing, or shipping carriers.
  • If your design includes parts that cannot be auto-assembled, those parts ship loose with the board for hand-assembly. You will be informed of any such parts before you accept the quote.
  • If you order an enclosure, you select the print material at quote acceptance. Some materials may not be compatible with every body in your enclosure design; you will be informed of any incompatibility before you accept the quote.
  • Once an order has been sent to production, it cannot be cancelled or modified.

Engineer Check Before Production

Before an order is sent to production, an electrical engineer on Tovan's team reviews the approved design. If the review finds a problem, Tovan will tell you by email and work with you to correct it at no additional charge. Corrections are limited to what is needed for the board to be produced and to function as designed. A correction becomes part of the approved design only when you approve it in Tovan. If, in Tovan's reasonable judgment, the design cannot be corrected, or if you do not respond to a correction request within 14 days, Tovan will cancel the order and refund the full order amount to the original payment method. If you decline a correction and ask Tovan to proceed, the order goes ahead on the design you approved at payment and this refund no longer applies to that finding. Tovan may decline to produce a design it considers unsafe and will refund such an order in full. Tovan aims to complete the review within one business day but does not guarantee a timeline. The review is intended to catch design problems before production; once an order has been sent to production, Section 5 and the Fabrication Defect terms in this Section apply unchanged.

What Tovan Is Responsible For (Fabrication Defects)

Tovan is responsible for ensuring that the physical board and (if ordered) the 3D-printed enclosure you receive match the design files you approved at the time of payment. The following constitute "Fabrication Defects" and are eligible for the remedies described below.

For PCBs:

  • Board geometry, layer count, copper, soldermask, or silkscreen materially deviates from the approved Gerber files.
  • Components are missing, placed at wrong locations, oriented incorrectly, or substituted without prior disclosure in the quote you accepted.
  • Manufacturing errors such as solder bridges, cold joints, lifted pads, or open electrical connections on tracks present in the approved files, where the defect violates IPC-A-610 Class 2 acceptance criteria.
  • The wrong order is shipped (i.e. you receive boards that are not yours).

For 3D-printed enclosures:

  • The printed part materially deviates from the approved 3D model (missing features, wrong body, wrong dimensions outside the print process's stated tolerance).
  • The part is printed in a different material or color than the one you selected at quote acceptance.
  • Visible print failure on receipt — including delamination, layer separation, broken or missing features, or large unintended voids — that would not pass standard quality inspection.
  • The wrong order is shipped (i.e. you receive a part that is not yours).

What Tovan Is Not Responsible For

The following are not Fabrication Defects and are not eligible for refund or rework:

  • Design defects. Boards or enclosures that are produced correctly per your approved files but do not function as intended in your application — including, for boards, incorrect schematic, wrong component values, invalid footprints, faulty topology, signal-integrity issues, thermal problems, EMC/EMI behavior, or firmware incompatibility; and, for enclosures, mechanical interference with the PCB, mounting holes that do not align, walls that flex or break in use, openings that do not fit your connectors, or any other fit, form, or function shortcoming. As described in Section 5 (AI-Generated Content) and Section 9 (Export & Manufacturing), you accept full responsibility for design correctness when you approve files for production.
  • Component performance variation. Parts that meet their published datasheet specifications but do not perform to your expectations.
  • Cosmetic variation within accepted process tolerances. For PCBs, minor variation in soldermask color, silkscreen registration, copper finish, or solder fillet geometry within IPC-A-610 Class 2 tolerances. For 3D prints, layer-line visibility, support-removal marks, minor warping, surface roughness, color variation, and dimensional variation within the stated tolerance of the selected print process and material.
  • Material limits. Mechanical performance of a 3D-printed part is bounded by the material you selected (strength, stiffness, heat resistance, UV stability, water tightness, etc.). Failure modes consistent with the material's published properties are not Fabrication Defects.
  • Damage after delivery. ESD damage, mechanical damage, contamination, modification, rework, or component or print failure occurring after the package is handed to the carrier.
  • Self-sourced and hand-assembly parts. Parts you provide, or parts that ship loose with the board for hand-assembly, are outside the scope of production; Tovan is not responsible for their performance once assembled.

Claim Process and Remedy

  • To claim a Fabrication Defect, email austin@tovan.ai within 14 days of delivery with the order number, clear photos showing the defect, and (where applicable) electrical measurements or dimensional measurements demonstrating the failure mode.
  • If the claim is valid, Tovan will, at its discretion, either rework or replace the affected boards or printed parts at no additional cost, or issue a full or partial refund of the order amount.
  • Claims submitted more than 14 days after delivery are not eligible.
  • Refunds, when issued, are returned to the original payment method within 10 business days of approval.

If Tovan Cannot Fulfill an Order

If Tovan is unable to fulfill an order for reasons not attributable to your design — including fab partner failure, prolonged supply-chain disruption, or any other cause that prevents production — you are entitled to a full refund of the order amount, regardless of the other terms in this Section.

Shipping

Shipping costs, where applicable, are included in the quote. Risk of loss transfers to you when the package is handed to the carrier. Loss or damage in transit is the responsibility of the carrier, not Tovan; we will provide tracking information and assist with carrier claims as a courtesy.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Tovan and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of the cause of action or theory of liability.

Tovan's total aggregate liability for any claims arising out of or related to the Service shall not exceed the total amount you paid to Tovan in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

You may stop using the Service at any time. You can delete your account by contacting us, and we will remove your personal data within 30 days.

We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in abusive behavior, or for any other reason at our discretion. We will make reasonable efforts to notify you before termination when possible.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.
